Should (Or Can) Justice Clarence Thomas Be Impeached?

What is Clarence Thomas smiling about and who are these two men standing so proudly along side the justice posing in this personal photo, one of which was posted to twitter?

Clarence Thomas, a man who was accused of sexually harassing Anita Hill before he was confirmed, probably should never should have been placed on the Court. In this photo, he is  proudly prancing for pictures with two of the nation’s most anti-gay activists/spokespersons with a big old stupid grin on his face. Why? Because he can without any concern for his job security.

Let’s look at the picture and the cast of characters involved in Thursday’s photo shoot:

From left to right we have Ryan T. Anderson, Clarence and Robert P. George. You may know Ryan as an activist working for the anti-gay Heritage Foundation. According to David Badash of

“[Anderson has] been the anti-equality voice on CNN, and he’s the co-author of the book What Is Marriage?: Man and Woman: A Defense, along with Robert George. Anderson believes gay people should forgo sex, does not believe in same-sex marriage – calling it a ‘lie’ – supports harmful ex-gay therapy, and says rights for gay people are ‘makebelieve.'”

Now let’s take a look at Robert George.

“Prof. George is a professor of jurisprudence at Princeton, and a visiting professor at Harvard Law School. He’s also the co-founder of NOM, the National Organization For Marriage. George has other notches on his anti-gay belt.

“He is a senior fellow at the Witherspoon Institute, which funded the embarrassingly flawed Regnerus anti-gay parenting study. He’s on an editorial board at the Deseret news, Utah’s largest paper – wholly owned by the Mormon Church. He’s on the boards of the Koch Brothers’ American Enterprise Institute, and the Becket Fund for Religious Liberty. . . . But one of his greatest claims to fame, aside from NOM, is drafting the Manhattan Declaration, which advocates for anarchy in the face of governmental support for the rights of a woman to choose, and same-sex marriage.”

So one must ask, what the hell are these three hugging for pictures and smiling like three fools at a carnival for when the Court is about to hear argument on the rights of gays to marry in the United States? In other countries, the citizens would throw a shoe at this threesome about now.

Many have demanded impeachment of Scalia and Thomas for their repeated play dates with lobbyists and other fringe groups with interest in cases before the Court. Demanding impeachment has never been an effective threat as only one justice has ever been impeached and he was later acquitted by the Senate. It simply does not happen. Why? Because those who must conduct the impeachment proceedings are filling their pockets from the same cash cows. You can’t set a precedent for impeachment proceedings when you are as dirty as the one you are trying to impeach. HERE are some answers to basic questions about the Supreme Court you may finding enlightening.

This isn’t the first time in recent years we have heard calls for impeachment. A few years back the court jester, Scalia, after his dissent in the Arizona immigration decision, was the subject of many queries as to whether he could be impeached. A year before that as the nation suffered the embarrassment of Constitution Day shortly after Citizens United, the question of impeachment was raised as to each justice that signed off on that case. And now with Hobby Lobby and the gutting of a key provision of the Voters Right Act, one of the crown jewels of the Civil Rights movement, I weep.

As for me, I will continue to fight the fight but not bound by the rules of my state bar that tries to keep me quiet by labeling my responsibilities as “Rules of Professional Conduct.” It is of no import as to how we get this man off the court. He simply isn’t worthy of the position he holds on the highest court in this land. After over three decades of practicing law, I am through. When one becomes too embarrassed to tell others what they do for a living, it is time to put the briefcase on the shelf and feel good about one’s choices in life.

Oyez! Oyez! Oyez! All persons having business before the Honorable . . . and that’s when I start to choke.
