Former FBI Agent: Boston Bombing Suspect Might Not Get Mirandized (VIDEO)

Pakman suspect

In discussing the Boston Marathon bombing, David brings up the fact that former FBI Agent Donald Borelli said, depending on the circumstances, the bombing suspect, when found, may not get Miranda warning. The implications of following our own laws in times of tragedy is the focus this show’s segment.

The point is made that when that suspect, whoever he, she, or they might be, is found, it may be a situation where law enforcement could use their discretion and not Mirandize is “imminent threat” is possible. David finds this “concerning on a number of levels.” Even considering the Supreme Court rule of 1984 that mandatory Miranda can be waived for that “public safety exception,” there are questions of civil liberties and due process.
